I see why the courts and taxpayers would want the parents of a child with special needs to "try out" the public school first. However there is alot left unsaid in the article as to whether an IEP took place with the public school to determine if the district could, in fact, meet the needs of the child. If at an IEP meeting it is apparent the school cannot meet the needs of a particular child then that should be as far as the parents should be required to take it. To automatically enroll a child in public school when there is doubt needs cannot be met is futile and detrimental to the child. It is crucial that proper intervention take place as early as possible to ensure the child can reach his or her full potential personally, acedemically and socially. It will be interesting to see what comes of this.
