1. Eva Moskovitz's statistics cannot be trusted. She claims that the school's teachers were chosen from over a thousand resumes. These were not resumes sent to the school as part of applications for employments. These were resumes posted to job/career databases. Her numbers are inflated. An interesting examination would involve checking the yield of accepted applications who a) actually attend the school and b) complete a year at the school. Many parents who "win" the lottery choose to send their children to other schools.

2.The union contract does not really limit the amount of time public school students spend in school. Many schools offer after school programs that keep students in school until 5 or 6 p.m. A close study of Moskovitz's school would reveal that for many hours in the school day, students at Harlem Success are not taught by certified teachers.

3. Calling these schools public schools may be true in regard to funding. However, English Language Learners and Special Education students do not often receive services at these schools and may be told to attend other schools. The resulting impact on test scores should be obvious.
