The U. S. congress can fix the partial birth abortion law legislatively if it needs to be done , and they should.
They can,and should also write Roe versus Wade into federal law by passing the freedom of choice act, and then perhaps death should be the punishment for any violation of the freedom of choice act .
You have to be able to over ride presidential veto too. Its probably a valid arguement that the the partial
birth abortion ban violates the commerce clause in the constitution and should be struck down on those
grounds by the supreme court. Scalia and Thomas are right about that one .****
