First, companies can make their own FMLA policies, as long as they are consistently applied. Second, it takes much more than a single slip of paper from doctor to be approved for FMLA and the fact is that most of the approval process is actually defined by the company implementing it.
Third, the reason that many companies have many of their employees on FMLA is that the companies force employess to use FMLA for any and all absences. So, if you have a cold and are out for a few days, the company forces the employee to take the time off against FMLA time limits. They do this so that if a real medical or care issues comes up, what was supposed to be 12 weeks of allowable coverage is either gone or near gone and then the company can just terminate the person.
Most problems with FMLA are problems manufactured by incompetent managers and HR departments.
Maybe Ms. Roth might want to try actually looking at some facts before she speaks so ignorantly.
