I do agree that in populated NYC areas, shooting fireworks is not the best idea. If the site is not suitable for safe use of fireworks, then I agree, people should find somewhere else to shoot them. But why does the situation in NYC warrant the ban over the entire state of New York? Even with consumer fireworks legalized, you'd still have to drive out of state to obtain them, and the ban in NYC could remain.

I also don't think it was appropriate to use the michigan mother case (in agreeance with Eric). She killed herself with a professional grade mortar rack that she obtained illegally, and clearly had no knowledge of how to use (Imagine a hardball traveling at 150+ miles per hours - that's basically what she was hit with). Lifting the consumer fireworks ban would not have any impact on this sort of thing, since it is already a FEDERAL CRIME to purchase and use commercial fireworks without an operator's lisence...
