Gary's article is well laid out, but as a matter of technical (or should I say legal) precision, it is slightly incorrect to say that the people in the UK enjoy less "First Amendment protections" than in the U.S.
In fact, there is no "First Amendment" in the UK.

It would have been more precise , and what I believe that Gary meant to say, is that free speech and the press enjoy less protection than in the UK precisely because there are few barriers for punishing unpopular, or even vaguely offensive speech. The constitutional safeguards that we enjoy in the US, both substantive and procedural, are simply not available there.
