The men from Moscow brought it to Litvinenko and it leaded by accident?

To clarify Mr Epstein's theory or add to it. The men came with the Po from Moscow on British Airways with it. They gave it to Litvinenko. It leaked, possibly without their knowing it at the time. They returned to Moscow.

As Litvinenko realized what happened, he decided to finger Putin for it.

This hypothesis says that everything before and after the poisoning incident is the same between the accident and intentional case except at the point that it leaked or was intentionally given to him without his knowledge.

Is there any way to distinguish this Accident Scenario from the Murder Scenario?
