During wartime even members of the media have a responsability and obligation not to jeopardize national security.
Certainly, the Executive branch must vigorously and aggresively investigate and prosecute anyone who discloses classified or OPSEC information to persons not cleared to receive such information.
Any disciplinary actions iniatiated against personnel who willfully violate their security aggreement by unauthorized disclosures ("Security Act") to members of the media or general public are warranted. The level of prosecution is determined by the degree of harm to national security.
Judge Chesney a Clinton appointee (1995) should understand that on appeal, reversal is all but certain. A dispicable NY Sun reporter who shopped for an activist judge sympathetic to his cause know that the constitution means nothing in the 9th Circuit seeks only to undermine the our governments ability to maintain order and protect state secrets.
The fourth estate should remember our enemies want to kill you too!
