Court Ruling Backs City On Suing Gun Stores

Submitted by bab, Aug 29, 2007 08:50

Judge Weinstein is anti-2d amendment. Okay, who cares? Two dozen gun dealers in a half dozen states have been shown to have sold an inordinate amount of the guns that have been recovered in NYC over the last decade or so. The sting operations (attacked for being of suspect legality themselves) have nevertheless demonstrated that these shops routinely engage in illegal sales (for example, where the real purchaser buys 6 Saturday Night Specials and has another person fill out the necessary paperwork). There is little to no enforcement against this activity. A suit brought in gun shops' states would clearly go nowhere, so what exactly should be done to get the shops to follow the law (which, incidentally, doesn't infringe on anyone's constitutional rights). The City's suits are not seeking money damages. They are for injunctive orders to have these handful of stores monitored for a period of time (a few years) only for the purpose of ensuring that they follow the law. How horrible.
