Bush used political trickery to get him appointed without a vote during a recess. And the full vote didn't take place this time because the comittee that would've sent it to the floor voted against it. So, there was a vote and correct Congressional procedures were, of course, followed.
It's also worth noting that the committee that voted against a full vote is Republican by a 10-8 margin.
I agree that there's plenty of childish behavior in Washington, but this doesn't seem to be a case of it.
