I agree with Dr. Hurt's assessment. The primary issue here is individual rights -- freedom of choice.

Any restaurant owner should be free to offer lighter, healthier dishes, or heavy, creamy, fatty foods. Any man on the street is free to decide where to go for dinner, and should be free to choose what to order when he gets there. That way every minute of every day, individuals can "vote with their feet" -- and their dollars -- for what they want and don't want.

Businesses then thrive or fail based on the justice of the free market. The government should keep its nose out of it.

I loved Dr. Hurt's title. Indeed a government that allows defacto private ownership while regulating the hell out of businesses has a name -- it's called fascism.
