Ms. Almontaser is applying for a vacant job. Discriminating against her for her prior resignation is illegal. Refusal to consider her application is per se discriimination. She is obviously qualified, since she held the job before; the job is obviously vacant, under Green v McDonnell Douglas she must be reemployed or NYC is subject to several million in damages.
