Liberty's Lamp Is Dimmed by 2nd Circuit

What is shocking is ignoring the obvious -- that Chinese husbands whose wives have undergone a forced abortion or sterilization may be coming to the United States, not to abandon their families, but rather to protect them! They can petition their immediate family members, including their spouses, after being granted asylum protection. The journey to the United States from China, often requiring being smuggled, can be extremely dangerous. It is often out of safety concerns that only one persecuted spouse comes to the United States first, often the husband, with the other spouse able to come legally to the United States as the beneficiary of an asylum claim without incurring the same dangers imposed by the smugglers for those coming illegally to the U.S. from China.
