This sounds like the same tired old "sweatshop" argument. Has anyone involved in this, from the judge down to the article author, stopped to ask the question, "How do these supposed "sweatshop" jobs compare to other career opportunities in these foreign countries?"
It has been proven over an over again that these factories and jobs INCREASE the standard of living in these countries. The pay and working conditions may be miserable compared to any job you can get in the US, but they are FAR better than other jobs available in these countries.
Just like Wal-Mart increases the standard of living in every town it opens a store in, it does the same for every country it opens a factory in.
Finally, the fact that some of the plaintiffs of this case are essentially suing Wal-Mart for offering low prices (thus causing their own wages at other companies to be "unfairly" depressed), further emphasizes how malicious and absurd this case is.
Throw the case out Judge Guilford.
