In the one case that went to trial (Brocade) even though the CEO was found guilty - the judge ruled no damages. So that should be a precedent for all these suits NOT to go forward. Why are they still pursuing this.
Nobody cares about non cash expenses, these are arbitrary anyway, and the feds are reaching calling this a criminal act when all companies chose the low strike price of the open quarter to grant employee options. The only cases that should be tried are those like United Health where the CEO walked away with hundreds of millions. For all the other companies where the CEOs got nothing, just leave these companies alone you bloodsuckers.
