The city has never addressed the 'toxic cleanup' problem, except for some soil borings at various locations. But, to speak to your question: The EDC (I assume) will start a re-zoning process and 'somehow' deal with an environmental problem that could scuttle the project completely. If, and when they award the development, we assume the environmental cleanup will be paid for by the developer. But, I am sure that the Army Corps of Engineers, and the Dept. of Conservation will scrutinize every move they make. And the law firm of Arnold and Porter will challenge the City's mechanics by challenging the EIS (Environmental Impact Study) by studiously dissecting each and every attempt to flout or circumvent the law.
