Mr. Dinallo does not consider the part lawyers play in raising malpractice premiums. He should be calculating the fees paid to lawyers who pursue nonmeritorious claims against doctors. These fees are an unfair burden on doctors, patients, insurers, and our court system, and we need to know how much money is being thereby siphoned off.

In addition, your article claims that doctors can pass on the cost of rising premiums by raising fees, but in the case of Medicare patients, this is not true. The government sets these fees, not the doctor.
