Smoke from my neighbors unit is making my family sick. I do not want to infringe on my neighbor's right to do as he pleases in the confines of his own home as long as his actions do not infringe on my rights. But his actions are more than an inconvenience or an annoyance; they are making me and my family sick. When he smokes, we suffer headaches and caughs.

In my mind, we are weighing the HEALTH of a nonsmoker against the CONVENIENCE of a smoker. It is inconvenient for a smoker to smoke outside, but it is detrimental to the health of a nonsmoker (deadly, according to some researchers) to breath SHS.

If we can require people to turn their music down at night, surely we can ask them to smoke away from a residential dwelling instead of subjecting their neighbors (and their nieghbors' children) to poisonous fumes.
