Obviously it is bad for US travelers that Virgin America is denied the the right to transport them in the US, but silly to blame the Secretary of Transportation. Her job it is to implement the laws promulgated by Congress, not to challenge them.
She probably considered that her time would be better spent pursuing other objectives, such as reducing congestion on the roads and at airports.
