Why would a rRed Sox fan go to a Yankee game, in NY, and root for Boston, knowing the outcome of their actions will cause anger with hardcore Yankee fans. If you ask me he should find the guys who beat him up and sue them, not take the easy way out and sue the Yankees who have to protect hundreds of thousands of fans. Here's a hint, go to a game in Boston root for the Sox all you want, you won't get beat up there!
