Professor Epstein makes very valid points about social and revenue gains to be achieved by reducing taxes on earnings and capital. And he is right on point in signaling that moving to a consumption tax system is very attractive. But he actually understates the case for a consumption-based tax system in two ways.
First, it is possible to design a consumption tax on a much broader tax base than the present income/payroll taxes. Second, moving to a national consumption tax to replace the present income/payroll/death taxes is actually not all that complicated or difficult. In fact, the legislation to do both already exists as the Fair Tax Act of 2007 (HR 25, S 25). The bill is simple, brief and better supported by economic research and analysis than any tax legislation in history.
The Fair Tax would greatly encourage more efficient allocation of capital, and would reach inherited wealth when it is spent for consumption. Finally, professor Epstein is very right that there is a very large savings to accrue to society from tax reform. By my calculation, the annual accrual to existing taxpayers from enactment of the Fair Tax would exceed $1 trillion. This consists of $300 billion in compliance costs; $345 billion in presently uncollectible income taxes reported; at least $345 billion in taxes from the presently underground economy; and, more than $10 billion in operating expenses of the IRS.
