"Rule of Law" refers to clear and transparent laws, due process and constitutional rights. "Rule of Law" does not mean any law, any interpretation thereof, and any murky regulatory interpretation is acceptable. in fact, it means jsut the oposite. Where zoning is unclear, its application can become arbitrary, violating due process and equal treatment. Where it arbitrarily delays projects, it impacts property values and uses.
Rule of Law refers to a transparency and due process of law that allows a well-functioning market and rights (economic and social) of citizens/residents. To equate the Ruie fo Law with jsutifying murky and often arbitrary zoning decisions is a contradiction in terms.
IN FACT, RULE OF LAW PRECLUDES NIMBYism because the concept of Rule of Law states that clear regulations must be applied equitably, in a timely fashion, across the City.
