Garbage Truck Driver Indicted in British Tourists' Deaths

A garbage truck driver who is accused of killing two English tourists after he had a seizure and lost control of his vehicle near Madison Square Garden has been indicted in connection with the deaths.

The sealed indictment was filed yesterday against 52-year-old Auvryn Scarlett of Irvington, N.J., in Manhattan Criminal Court. A complaint filed when Mr. Scarlett was arrested said he admitted to police he failed to take his anti-seizure medication.

Mr. Scarlett's indictment charges will be disclosed and he will enter a plea when he is arraigned in state Supreme Court on March 12. When he was arrested last week, Mr. Scarlett was charged with manslaughter and reckless endangerment.

Judge James Gibbons ordered Mr. Scarlett held in $250,000 bond or $100,000 cash.

Mr. Scarlett's lawyer did not immediately return a call for comment.
