Transit Unions' Leave Claim Dismissed
A panel of three federal judges today in the Second Circuit U.S. Court of Appeals in New York dismissed a claim by three transportation labor unions against the New York City Transit Authority alleging that the authority's sick leave policy requiring employees to file written reports detailing their sickness violates the Americans with Disabilities Act.
The authority maintained its policy existed to curb the abuse of sick leave and to maintain workplace and public safety. The case was brought before the U.S. District Court in Manhattan in 2002 by the national Transit Workers Union, the TWU Local 100 branch, and the Amalgamated Transit Union Local 726.
