Federal prosecutors are opposing a bid by a top class action lawyer, Melvyn Weiss, to move his trial on fraud and racketeering charges to New York from Los Angeles. “Defendant Weiss is well accustomed to spending weeks, if not months, away from home in connection with litigating and trying cases throughout the country,” prosecutors said in a court filing last night, adding that moving the case to New York “would be extraordinarily burdensome.”
Mr. Weiss and his firm, Milberg Weiss, were charged by a Los Angeles grand jury with making secret, illegal payments to plaintiffs in securities cases. Two former Milberg partners who pled guilty in the case, Steven Schulman and David Bershad, also oppose moving the trial to New York.
