State Found Liable In Inmate Sexual Assault

The state has been found liable because an inmate who was ordered into protective custody after he was sexually attacked by another inmate was instead returned to the general jail population and was attacked again. The 5-0 ruling by the state Supreme Court’s Appellate Division reversed a lower court decision and means that the plaintiff is entitled to a trial on the issue of how much money the state must pay him.
