After Vacation, Subpoena May Be in Mamdani’s Future

New York City councilmembers say failure to answer a raft of written questions they plan to send to Mayor Zohran Mamdani’s administration will result in a subpoena, after denouncing the mayor for refusing to send a representative to answer for the bungled rollout of the city’s new tax on second homes. Councilmember Gale Brewer was among a group of lawmakers representing the Upper West Side and Staten Island who told reporters assembled outside City Hall ahead of Tuesday’s oversight hearing that if the administration dismisses lawmakers’ calls for accountability, the council will escalate its authority.The council will compel the administration to answer for its confusing and aggressive treatment of homeowners, which included a highly publicized list of all of the city’s residential property owners and notices that initially gave 17,000 homeowners one month to prove their residency in the city or face property surcharges starting at $40,000. While the mayor has said publication of the list was required by the state law that created the pied-à-terre tax, Ms. Brewer and Councilmember David Carr said Tuesday they could not find such an obligation in the law.Ahead of the hearing, Councilmember Kamillah Hanks endorsed Ms. Brewer’s readiness to compel the mayor to appear.Lawmakers would press the administration to take responsibility “by any means necessary,” Ms. Hanks told The New York Sun, emphasizing the need for the council to be “exacting” in order to rebuild public trust in response to the sloppiness of the rollout.“A PDF can’t answer follow-up questions,” Councilmember Frank Morano told reporters, referencing the written testimony the Department of Finance Commissioner Richard Lee submitted instead of appearing.The mayor’s office on Monday confirmed to the Sun that no representative would attend the oversight hearing, citing ongoing litigation over the rollout against the city brought by disgruntled homeowners, including Mr. Morano’s wife and father. That lawsuit seeks to block implementation of the surcharge, claiming harm caused by the city’s high-profile publication of homeowner data and failure to conduct basic vetting before issuing surcharge letters. A judge on New York’s Supreme Court briefly blocked the rollout before the city successfully appealed that order earlier this month. Mr. Morano was the architect of Tuesday’s joint hearing between the council’s Committee on Governmental Operations, State & Federal Legislation and Committee on Finance. The hearing was proceeding to allow homeowners the opportunity to speak directly to the council. Mr. Mamdani is spending the third week of August on vacation in upstate New York with family members.In written testimony the Department of Finance submitted ahead of the hearing, Mr. Lee said the council had refused his request to postpone the hearing until after August 31, when a New York Supreme Court judge is scheduled to rule on the lawsuit challenging the rollout. New Yorkers who addressed the council at Tuesday’s hearing assailed that justification citing routine oversight appearances by other administrations during lawsuits. The co-founder of the American Real Estate Association, Jason Haber, cited two appearances at oversight hearings by De Blasio administration housing officials in 2016 and 2017 despite ongoing litigation.Mr. Haber took sharp aim at the property tax roll attached to the surcharge website in his testimony. “ With two clicks, a person could download an entire list larger than the population of San Francisco. Imagine the gift that this is to fraudsters, to scammers, to anyone with ill will,” Mr. Haber told the council members, referencing the list of more than 900,000 properties, their owners, and the assessed values published by the Mamdani administration last month. “Now, what does the administration have to say about the release of this information? Well, we heard from the letter that they’re not able to comment today.”Mr. Haber, who stood with fellow opponents outside City Hall ahead of the hearing with placards reading, “Guilty until proven resident” and “Dox you very much,” later told lawmakers that after downloading the massive data table, he was able to create an app that could filter homeowners by their likely ages. “ If I could do it in two hours, and I’m not even a computer programmer, imagine what someone could do who wanted to do harm to New Yorkers. It’s just that easy, and it’s just wrong,” Mr. Haber said. In his written testimony, Mr. Lee called the city property tax rolls, which are published each year in January, “highly accessible to the public,” a distinction Mr. Haber noted is quite different from published and ready for download.Other witnesses took issue with the rapid and “totally confusing” messaging around the rollout, as former president of the Service Employees International Union, Kyle Bragg put it. Mr. Bragg related the concerns of his friend, a brownstone owner whom he said served the city for 50 years before moving south “ to seek warmer weather and to stretch his retirement dollars,” but keeps his family home for regular visits to see his children and grandchildren. The witnesses at Tuesday’s hearing also included supporters of the tax, who said it will provide a sorely needed boost to the city’s schools, which draw 43 percent of funding from property taxes. Ms. Brewer responded to their testimony by reaffirming her and other members’ overall support for the pied-à-terre tax, despite significant concerns with its implementation.If the city wins the lawsuit, New Yorkers who received Department of Finance notices this summer will have just over two weeks to prove their residence or face additional property taxes starting at $40,000 if they don’t file for exemptions by September 18.Ms. Hanks, who represents Staten Island alongside Mr. Carr and Mr. Morano, deemed the property list a “hit list of haves and have nots,” while Councilmember Vickie Palladino went a step further.“This tax is being implemented for one reason. It’s being implemented because we’ve watched this administration go after private ownership,” she said. “This is eminent domain, folks. Because if you cannot pay your property taxes, what happens after that? They come in and they swoop up property.”
