Alberta Mulls Response to Court Ruling Blocking Independence Referendum in Oil-Rich Canadian Province

Alberta’s government is considering its next steps after a judge threw out a petition that would have forced a referendum on independence for the oil-rich province in response to a challenge from indigenous tribes — known in Canada as First Nations — who argued that the petition violated their treaty rights.“We think that this decision is incorrect in law and anti-democratic, and we will be appealing it as a result,” Premier Danielle Smith told reporters after Wednesday’s ruling, which she cast as an affront to the more than 300,000 Albertans who had signed the petition.“Our cabinet and caucus will, of course, be meeting in the next couple of days to discuss the full context and make some decisions after we’ve had a chance to talk it through,” she said, according to the Canadian Broadcasting Corp.Ms. Smith and her United Conservative Party officially oppose separation from Canada, arguing in favor of what they call “sovereignty within a united Canada,” including a right to block federal laws and policies considered harmful to the western province, sometimes dubbed “the Texas of the North” because of its oil- and cattle-based economy.However the party also casts itself as a strong defender of direct democracy. Besides the promised appeal, the provincial government could reinstate the referendum through an act of the legislature, possibly adding it to an already scheduled October 19 referendum calling for greater provincial control over immigration and for constitutional limits to federal power over the provinces.Wednesday’s court ruling hinged on Canadian law that says indigenous peoples must be consulted in good faith when the government is considering actions that could infringe on their aboriginal or treaty rights. Justice Shaina Leonard found that no such consultation had taken place with the four tribes that challenged the referendum — Athabasca Chipewyan First Nation, Blood Tribe, Piikani Nation and Siksika First Nation.Chief Samuel Crowfoot of the Siksika First Nation told the CBC that the ruling drove home the point that treaties are not mere historical documents but “living constitutional agreements.”“The Alberta government would do well to change their course in dealing with First Nations and engage with us in a respectful and meaningful way when it comes to consultation,” he said.A lawyer for the petition organizers, Stay Free Alberta, said his group is planning its own appeal of the ruling.“We disagree fundamentally with the decision which appears on its face to violate the principles of natural justice and contain numerous errors of law,” Jeff Rath said in a statement, according to CTV News. He urged Ms. Smith to act on her own to call a referendum on separation, as “301,620 Albertans expect her to do so.”While the Alberta separatists maintain they seek independence, not annexation by the United States, the campaign has implications for America, which imports roughly 5 million barrels of oil per day from Alberta. Prime Minister Mark Carney has been working to shift more of that production to China and other Asian countries in response to American tariffs.Organizers of the campaign say they met with Trump administration officials in Washington three times last year and have asked the United States Treasury for a $500 billion line of credit to bankroll a new country if they are successful.The group said in January it had scheduled another meeting with American officials, but after Prime Minister Mark Carney urged the Trump administration to “respect Canadian sovereignty,” the State Department told Reuters there would be no future meetings.Nevertheless, Canadian researchers reported last month that they had uncovered a network of some 20 YouTube accounts using AI avatars or voice actors pretending to be Alberta residents to promote the annexation of the province by the United States.
