Democrats Push Companies To Pass Tariff Refunds Along to Consumers, but Trump Administration Balks at Starting the Process

Congressional Democrats are asking companies to pass along expected tariff refunds to American customers, but the wait for money could drag out as the Trump administration is indicating it wants to delay or entirely block the “complex and time-consuming” process.Senators Chuck Schumer and Ron Wyden wrote a letter to the U.S. Chamber of Commerce’s chief executive, Suzanne Clark, claiming American families “deserve to be made whole.”The chamber filed an amicus brief with the trade court on Wednesday asking for an “efficient, orderly process” to deliver refunds to businesses that paid President Trump’s tariffs. The organization has been fighting for refunds for small businesses since the Supreme Court ruled them illegal last month.Some companies have already pledged to pass along any refunds. Shipping company FedEx released a statement last month saying, “Our intent is straightforward: if refunds are issued to FedEx, we will issue refunds to the shippers and consumers who originally bore those charges.”Other companies that have promised to pass along any refunds including game maker Cards Against Humanity and sex toy company Dame Products.Fed Ex said it was still waiting to see the exact process for getting refunds. That process appears to be accelerating.A judge at an obscure federal court that is the arbitrator of trade disputes released an order on Wednesday directing the Trump administration to begin issuing refunds, but an appeal is expected.A group of small businesses sued the Trump administration, claiming its use of the 1977 International Emergency Economic Powers Act to impose global reciprocal tariffs was an overstep of presidential powers. A divided Supreme Court agreed in a decision released last month but it sent the question of refunds back to the lower court to decide.The Court of International Trade has now quickly ordered the refunds after a hearing in Manhattan on Wednesday. “You have to do it now,” Judge Richard Eaton told a government lawyer.The hearing was over a lawsuit filed by a company seeking an injunction blocking the government from “liquidating” — or finalizing the total tariffs amount owed — without stripping out the wrongly collected tariffs. The United States Customs and Border Protection agency automatically finalizes tariff determinations 314 days after the goods enter the United States, effectively locking the payments in permanently.Judge Richard Eaton ordered the government to finalize the tariffs while accounting for the duties and issuing rebates.“The customs service knows, right now, the amount of customs duties that were deposited by your clients in the exact amount deposited with respect to the IEEPA duties,” Judge Richard Eaton told a lawyer for one of the companies fighting for refunds.“I believe there will be no chaos,” Judge Eaton added.“This is the most significant development on IEEPA refunds since the Supreme Court ruling itself,” customs and trade attorney James Kim said in a LinkedIn post. “Even so, importers should continue to monitor liquidation dates and protest deadlines.”A coalition of companies that were against the tariffs celebrated the decision. “This is a victory for small businesses who have paid billions in unlawful tariffs and deserve their money back,” the executive director of the We Pay the Tariffs coalition, Dan Anthony said in a release.“The Court acted swiftly and correctly. Now the ball is in the government’s court and small businesses are concerned they will drag this out further,” Mr. Anthony continued. He added that an automatic refund process is what businesses are owed and “anything less is unacceptable.”The coalition says that more than 1,000 small businesses have signed a letter to Congress and the Trump administration calling for full, fast, and automatic refunds, but they’ll probably need to continue waiting before they see any money back. The Trump administration is expected to appeal the decision.Judge Eaton denied a Justice Department request to pause his order to give the administration time to fight it. “There are no merits,” Judge Eaton told the government of its case. An appeals court could still agree to give the pause while the government tries to lay out its case.More than 2,000 companies preemptively sued the Trump administration to secure refunds before the Supreme Court decision. Retail giant Costco claimed the administration was refusing to extend a deadline that effectively made the tariffs non-refundable.Judge Eaton scheduled a Friday hearing to deal with the status of the suits that have been filed and duties involving companies that have not filed suit. “We don’t want people who are due a refund to have to file suit,” the judge added. “We want to work out a method by which those importers can make a claim for duties that were unlawfully applied.”The administration has already started the process to resume charging tariffs under different means. Mr. Trump said he would use Section 122 of the Trade Act of 1974 to implement the new 10 percent duty. He later said he would up the tariffs to 15 percent.A group of 24 Democrat-led states filed a new lawsuit on Thursday in the trade court. The suit claims Mr. Trump’s new tariffs are also reliant on a law that also has never been used to levy tariffs.“The focus right now should be on paying people back, not doubling down on illegal tariffs,” Oregon’s attorney general, Dan Rayfield, said in a statement.The White House did not immediately reply to a request for comment.
