Germany Drops Enforcement of Conscription Rule After Taking Recruits By Surprise

Germany is walking back some of its reporting obligations for military-age men after a delayed uproar following passage of a law that requires men over age 18 to notify the government if they are planning to travel abroad for three months or more. The decision came after a Frankfurt newspaper on April 3 reported what the German government had failed to tell 20 million German men aged 17 to 45 on January 1 — that they had to obtain permission from a Bundeswehr Career Center before leaving the country for an extended period. The lower chamber, the Bundestag, approved the rule embedded into Section 3, Paragraph 2 of Germany’s amended Conscription Act on December 5, 2025, as part of a broad reform to the Military Service Modernization Act. It cleared the upper chamber of Parliament, the Bundesrat, on December 19, and entered into force at the top of the new year. The requirement applied regardless of whether Germany was under any military threat, covering any extended absence — a semester abroad, a work assignment, a prolonged holiday. A Defense Ministry spokeswoman confirmed the rule to Ippen.Media, saying, “In an emergency, we need to know who is potentially staying abroad for a longer period.”The men it affected were apparently among the last to find out. Now, the defense ministry has not so much reversed course as deferred it. Defense Minister Boris Pistorius announced that permission would be treated as granted automatically for as long as military service remains voluntary — meaning no man currently needs to file an application. But the statute itself was not amended. The move to get a tighter grip on conscription followed a vow by Chancellor Friedrich Merz to turn the armed forces, the Bundeswehr, into “the strongest conventional army in Europe.” His coalition also amended Germany’s constitutional spending rules, the “debt brake,” to allow for a massive increase in defense expenditure.The legal obligation now sits dormant, not erased, just not enforced. It will be revived the moment conscription is activated or the security calculus shifts. Yet what passed with little scrutiny took three months to surface in the public consciousness. The travel-permit provision attracted no public debate during the vote on the bill that drew attention primarily for its plans to expand military service requirements.What changed in the law was a single sentence. A travel-permission requirement had long existed on the books but was limited in its application to a declared state of tension or state of defense, meaning an actual armed attack on Germany. In peacetime, it simply did not apply.In December, lawmakers added the phrase “outside a state of tension or defense, Section 3 applies,” and with that addition, the exit-permission requirement became permanently applicable.The framing of the rule, however, is not new. From 1977 until July 2011, conscripts who wished to leave Germany for more than three months had to obtain permission from the district military recruitment office. At that time, the government stopped enforcing the law.“Such a regulation already existed in the past in connection with compulsory military service, which was merely suspended in 2011, not abolished,” Senior Policy Fellow Jana Puglierin, who heads the Berlin office of the European Council on Foreign Relations, told The New York Sun.“The core principle, the requirement to report or obtain approval for extended stays abroad by conscripts, was thus enshrined in law until 2011 and became relevant again with the reintroduction of the registration requirement in 2026,” Ms. Puglieren said.Ms. Puglieren added that debate over the new rule was likely overlooked because it was part of a larger discussion over the reintroduction of compulsory military service, registration requirements, and physical examinations for potential male and female soldiers.Berlin’s justificationThe government’s rationale was framed in modest, technical terms. Officials insisted that approval would be automatically granted as long as military service was voluntary, a census mechanism, not a travel ban. The ministry acknowledged the impact on young men was “profound,” yet published no application process, form, or procedural guidance, and offered no answer when asked what consequences a man would face for leaving without permission.That gap — between a permission requirement routinely granted and no requirement at all — is where the constitutional tension sits. Germany’s Basic Law guarantees freedom of movement under Article 11, with Article 2 protecting personal liberty more broadly. German lawyers noted a violation could theoretically lead to a fine, passport confiscation, or a travel ban.Ms. Puglierin pointed out that the situation is far from unique to Germany.“In Finland, you won’t even receive a passport after your 17th birthday unless you have completed military or alternative service, deferred it, or been exempted from it,” she told the Sun. “I think the whole thing is much less dramatic and, above all, by no means unique.”The rule also complicates matters for dual nationals. Germany’s 2024 citizenship reform, which permits dual nationality, has expanded the affected cohort: roughly one in six German men born in 2008 already holds a second passport, according to the Federal Statistical Office, and the new law explicitly requires young men to declare all citizenships held in a mandatory readiness questionnaire.Germany’s growing defenseBerlin has committed to hiking defense spending to 3.5 percent of GDP by 2029, projected at roughly $188 billion a year, as the Bundeswehr aims to build from approximately 184,000 active troops to between 255,000 and 270,000 by 2035.The Military Service Modernization Act does not reintroduce conscription but preserves the infrastructure for a potential return to mandatory service. Should voluntary recruitment fall short, the law provides the Bundestag with a mechanism to activate needs-based conscription through separate legislation.Full-year figures show 3,879 conscientious objector applications were filed in 2025 — the highest annual count since conscription was suspended.Public reaction has been uneven. A YouGov survey found 58 percent of Germans support reinstating conscription. Yet, a separate poll found only 16 percent said they would “definitely” fight to defend the country. The gap between supporting a policy in principle and being willing to live under it is not small.Even with the blanket exemption now promised, legal challenges are being prepared, with advocacy groups intending to test the regulation before the constitutional courts. As for the government’s belated transparency, Ms. Puglierin acknowledged room for criticism, while declining to treat the episode as a scandal.“The federal government — or rather, the Department of Defense — should certainly have been more transparent about this and explained it better,” she added. “But to blow this out of proportion now is a bit absurd, because it was already the law as of 2011 and had virtually no practical impact back then either, since there were no penalties.”
