ICE Detention Facilities Budget Builds Private Prison Bonanza

Immigration and Customs Enforcement now holds a record 73,000 people on any given day — a detention population that has nearly doubled since President Trump returned to office just more than a year ago. The daily cost has climbed to roughly $165 per detainee, totaling approximately $4.4 billion annually at current levels. Yet that figure represents merely the starting point of what has become the most dramatic expansion of immigration detention infrastructure in American history.In July, Congress passed the One Big Beautiful Bill Act, allocating $45 billion over four years specifically for ICE detention. That massive surge brings ICE’s annual detention budget over the next four years to roughly $15 billion annually, explains a senior fellow at the American Immigration Council, Aaron Reichlin-Melnick.The funding surge transforms ICE into the highest-funded law enforcement agency in U.S. history — surpassing even the entire federal prison system’s budget.“The $3.4 billion expenditure for ICE detention funds 41,500 beds,” Mr. Reichlin-Melnick tells The New York Sun. His group estimates the expansion could enable ICE to operate around 135,000 beds yearly through 2029 — rivaling the entire federal prison system’s capacity.“This amount is very controversial and is likely to receive significant oversight and potential cuts should the Democrats retake the House next year,” Mr. Reichlin-Melnick notes.The financial windfall flows overwhelmingly to private contractors. The dominant players in immigration detention, CoreCivic and GEO Group, operate the vast majority of ICE facilities under contracts paying per diem rates for each detained person.Their business model remains elegantly simple: more beds filled, more extended detention periods, greater revenue. Their contracts typically include guaranteed minimum occupancy requirements, meaning taxpayers fund a specific bed count regardless of actual use though some facilities operate under agreements requiring ICE to maintain 90 percent or higher occupancy. The deal effectively creates financial incentives to keep detention numbers elevated.GEO Group and CoreCivic together grossed over $1.1 billion from ICE contracts in fiscal year 2021, according to financial disclosures. CoreCivic reported over $1.9 billion in total revenue in 2023, with substantial portions from federal contracts. Industry critics view this payment structure as emblematic of a system designed more for profit than efficiency. When companies receive guaranteed payments based on occupancy rather than outcomes, financial incentives don’t align with streamlined case processing or cost-effective alternatives, they say.Proponents, however, counter that guaranteed occupancy contracts provide fiscal stability necessary for maintaining detention infrastructure and staffing levels, regardless of fluctuating enforcement priorities. Private prison executives note that bed guarantees also ensure capacity remains available when enforcement demands surge. They add that private prison facilities offer cost savings compared to government-run operations while meeting ICE detention standards because they offer essential services that government cannot efficiently deliver alone. CoreCivic, GEO Group, and the Department of Homeland Security did not respond to the Sun’s requests for comment. Itemizing the Daily RateThe current $165 daily cost per detainee encompasses more than basic housing. Facilities must provide meals, round-the-clock security, transportation, legal resources, infrastructure maintenance, and medical care, including mental health services. Medical care alone drives significant expenses as the detained population often includes individuals with chronic conditions requiring specialized treatment.Staffing constitutes another significant expense. Detention centers demand 24/7 security personnel, medical staff, case managers, and administrative workers. Many facilities are in remote locations, where recruiting qualified staff requires premium wages to compensate for geographic isolation.Transportation adds yet another unpredictable cost layer. Moving detainees between facilities to immigration hearings or deportation proceedings requires coordinating security personnel, vehicles, and, sometimes, aircraft. Some individuals are transferred multiple times during detention, multiplying expenses.Still, transparency around actual spending remains limited. While ICE reports aggregate costs, detailed breakdowns by category or facility prove elusive, making it difficult for taxpayers and policymakers to assess whether the system delivers value or perpetuates an overpriced status quo.Indefinite StaysHow long a detainee is held is another unknown. Unlike criminal sentences with defined terms, immigration detention operates in legal gray zones where individuals can remain confined for months or years while cases work their way through immigration courts. This indefinite quality drives costs upward as daily charges accumulate.The immigration court backlog has swelled to over 3 million pending cases. The crushing caseload does move more quickly for detainees, in part, says Mr. Reichlin-Melnick, because the government knows where to find them, in part because they represent a smaller population than those outside detention facing removal proceedings, and in part because individuals give up some of their rights in order to get out.“Cases in detention take a matter of weeks or months, compared to years outside of detention, because the government prioritizes hearing these cases,” Mr. Reichlin-Melnick explains. “This has incentivized ICE officers to push people to abandon their right to a fair day in court and instead accept removal,” he adds, noting the flip side of exercising rights while in detention. “Individuals who fight their cases in court are more likely to be detained for lengthier periods, often for months.”The lengthy detention periods also raise questions about cost-effectiveness. Despite the cost differentials, ICE’s budget increasingly prioritizes detention over alternatives even though research suggests that appearances in court remain at the same level regardless of whether an individual is in detention or is being tracked by alternative measures, including electronic monitoring, regular check-ins, and community-based case management, whose daily costs are $8 to $30, a fraction of the $165 detention price tag. At the same time, claims of removing the “worst of the worst” don’t bear out statistically. Since January 2025, the composition of ICE’s detained population has shifted dramatically. As of late November 2025, 73 percent of individuals held in ICE detention had no criminal conviction, and fewer than 5 percent had violent criminal convictions — a sharp reversal from previous administrations when most detainees had criminal records.This shift follows policy changes expanding mandatory detention requirements. Between September 2025 and January 2026, 92 percent of detention growth came from individuals with no criminal convictions — raising fundamental questions about fiscal priorities and enforcement focus.What remains striking about the detention expenditure is how little sustained public attention it receives, given its magnitude. This spending exceeds entire federal agency budgets, yet congressional oversight hearings specifically examining detention costs and effectiveness remain relatively rare.Part of this scrutiny gap stems from the complexity of immigration policy, where detention is subsumed into broader border security debates rather than examined as discrete budget items with independent cost-benefit analyses. Dollars flow to facilities often located in rural areas far from major media markets, making on-the-ground reporting and public awareness more challenging to generate.Private prison companies maintain active lobbying operations in Washington, ensuring their interests are represented as detention policy is shaped. GEO Group and CoreCivic spent $1.38 million and $1.77 million, respectively, on federal lobbying in 2024. Meanwhile, the people most directly affected — the detainees themselves — have limited platforms to raise questions about conditions or costs.As the Trump administration remains committed to pursuing expanded immigration enforcement, the detention population seems poised to grow further, pushing costs higher still. Whether this trajectory prompts a more rigorous examination of where these billions flow and whether the system delivers results justifying its costs remains uncertain.
