Justice Department Launches Antitrust Investigation into Major Meatpacking Companies as Price of Beef Nears Record High

The U.S. Justice Department has officially launched a criminal investigation into potential antitrust violations within the meatpacking industry, seeking to determine whether soaring beef prices are linked to illegal, anticompetitive practices by the nation’s largest meat processors.Following President Trump’s initial request last November, Acting Attorney General Todd Blanche announced Wednesday that the department has already reviewed more than three million documents and interviewed various industry participants to uncover alleged price-fixing, bid-rigging, and procurement fraud. “Multiple plant closures across the country, the current market structure, and high concentration in the industry indicate anti-competitive activity,” Mr. Blanche said in a statement. He urged ranchers, purchasers, and processors to report illegal activities, highlighting the DOJ’s fraud whistleblower rewards program.“If the information you provide helps us secure a criminal penalty in excess of $1 million, you can be entitled to recover and receive 15-30% of the money that we recover,” Mr. Blanche said. The investigation is heavily focused on the “big four” beef processors — JBS, Cargill, Tyson Foods, and National Beef. According to Agriculture Secretary Brooke Rollins, these corporations control “roughly 85% of the cattle processing market,” with significant Brazilian ownership of JBS and National Beef.“Together, these companies operate through dozens of subsidiary businesses, creating a landscape that leaves many of our cattle producers with limited marketing options,” Ms. Rollins said in a post on X. “For some ranchers this means less marketing opportunities, complicating an already challenging marketplace. We must work to address this to protect our ranchers and consumers.”Beyond market consolidation, Ms. Rollins emphasized severe supply shortages. The American cattle herd recently dropped to about 86.2 million head, which she called “the lowest since the 1950s.”“Over the past decade alone, we’ve lost more than 17% of our cattle ranchers, with over 100,000 ranches disappearing across the country,” Ms. Rollins said. She attributed the decline to years of drought, wildfires, market volatility, and overregulation, but also sharply criticized the “radical left’s climate alarmism.” She also condemned activist “alarmism to wage a war on cattle in America” and what she called “the radical left’s ongoing assault against ranching as a way of life.”Looking forward, she said, “Growing the herd size is an immediate problem in need of solutions, and we’ve already begun implementing across the government and into the states how we’re going to solve for that.”The industry, meanwhile, argues that high prices are a result of basic economics, not market manipulation. Citing recent data, the Meat Institute said in a statement that it is the market fundamentals of supply and demand that are at work. Because the cattle herd is at a 75-year low, cattle producers are seeing record prices, while beef packers have suffered under negative margins since September, 2024.The trade association also pushed back against the administration’s claim of increasing consolidation. “Rhetoric about beef industry concentration implies that consolidation in the beef packing sector is ongoing and that market power is becoming increasingly concentrated,” the organization said. “That is not the case.”
