Louisiana Lawmakers Advance Bill Protecting College Faculty Members’ Ability To Engage in the ‘Rigorous Exchange of Ideas’

As conservative states are working to protect free speech on college campuses, lawmakers in Louisiana are advancing legislation aimed at protecting faculty members’ ability to engage in the “rigorous exchange of ideas.”The Louisiana House voted 103-0 on Monday to pass H.B. 1008, which aims to bolster academic freedom and free speech protections by prohibiting public colleges from firing professors for their research, teaching controversial topics, or for their statements outside the classroom. The bill’s sponsor, Representative Chuck Owen, who previously worked as an adjunct professor, told the education committee, “I would like to send a clear signal that in the state of Louisiana, we value academic freedom.”“We value the time that our professors, our adjunct faculty, our assistant professors, put in, and we want them to be able to speak freely in their classes,” he said. The bill prohibits public colleges from “retaliating against faculty members for disclosing certain alleged violations or exercising academic freedom or free speech.”It describes “academic freedom” as “the right of faculty members to teach, research, publish, and express views on matters within their field of expertise without interference, consistent with professional standards and any applicable state law. Academic freedom includes the freedom to educate and to engage in the open exchange of ideas and evidence.” The bill also says that it protects “teaching topics that some may consider controversial,” and “extramural free speech involving public appearances, publications, and other expression on topics outside [a professor’s] academic field.”The legislation clarifies that it does not “limit or restrict the authority of an institution to make legitimate, merit-based personnel decisions.” It also says it does not restrict the ability of institutions to enforce standards of professional conduct.”It comes as several states have taken steps to protect free speech on college campuses in the wake of the assassination of conservative commentator Charlie Kirk. Many bills have focused on protecting the speech of students or guest speakers, such as Tennessee’s Charlie Kirk Act. That bill prevents public colleges from disinviting a speaker invited by a student or student group because their speech is offensive. It also provides protection for academic freedom. Some advocacy organizations have said that Republicans have also advanced laws that could be used to target college faculty members for disfavored speech or research. Earlier this month, Kentucky’s legislature overrode Governor Andy Beshear’s veto of a bill that would let public colleges and universities lay off tenured faculty for “bona fide financial reasons.” The president of the American Association of University Professors, Todd Wolfson, said in a statement that the law could “be invoked to shut down research programs whose findings go against the financial interests of board members, to eliminate academic departments that have become easy ideological targets nationwide, and to silence faculty members whose speech board members dislike.”There have been concerns about professors being punished for disfavored speech in recent years. Last year, a Texas A&M professor, Melissa McCoul, was fired after an encounter with a student went viral. The video, which garnered the attention of state Republicans, showed a student arguing that Ms. McCoul’s teaching about gender identity violated an executive order from President Trump. In February, Ms. McCoul filed a lawsuit, arguing that the termination violated her First Amendment rights in order to placate Republicans. Conservatives have also raised concerns about academic freedom and professors being targeted for disfavored speech. In 2024, the University of Pennsylvania suspended a law professor, Amy Wax, for a year and reduced her pay. Students had called for her to be fired in 2017 when she co-authored an opinion article that argued Anglo-Protestant values were superior. In 2018, she was banned from teaching first-year courses for a year after she said on a podcast that she had never seen a black law student graduate in the top quarter of their class. Louisiana’s bill has won praise from free speech activists. An attorney for the Foundation for Individual Rights and Expression, Tyler Coward, noted that there is not a large movement to shore up academic freedom protections for faculty members.“This bill is a really big, bright spot, and a really good faith effort to ensure that faculty members from all sides of the political spectrum are protected at Louisiana state colleges and universities,” he said. While Mr. Coward called the bill a “big win for faculty rights,” he did express concern with the last-minute addition to the bill, which states that it does not protect “threatening, intimidating, harassing, demeaning, or coercive conduct.”He noted that “threatening,” “intimidating,” and “harassing” have clear legal definitions, whereas “demeaning,” “abusive,” and “coercive” are not “rooted in any legal” standard and are “ripe for abuse” without a legal definition. Lawmakers removed a provision that would have made it easier for faculty members to sue over alleged violations. They also struck a provision that would have made the bill retroactive to January 1, 2025. That month, a professor at LSU, Ken Levy, was removed from the classroom after he made profane comments about Louisiana Governor Jeff Landry. The bill now heads to the state Senate.
