Trump Administration To Begin Refund of $150 Billion in Tariffs to Importers

The Trump administration, on Monday, will begin the process for companies to request refunds for more than $150 billion in tariffs that the Supreme Court ruled were improperly collected.The United States Customs and Border Protection agency said in a court filing this week that it is finishing the process to build a refund system. It plans to activate the first phase of its new Consolidated Administration and Processing of Entries system to allow companies to apply to request the money.The first phase is set for lower-complexity scenarios, which is expected to be about 80 percent of tariffs charged under President Trump’s Liberation Day tariff scheme. About $127 billion in tariffs are expected to be refunded in the first phase. Customs officials anticipate refunds to be issued electronically within approximately 60 to 90 days.A group of small businesses sued the Trump administration last year, claiming its use of the 1977 International Emergency Economic Powers Act to impose global reciprocal tariffs was an overstep of presidential powers. A divided Supreme Court agreed in a decision released in February but it sent the question of refunds back to the lower court to decide.A judge at an obscure federal court that is the arbitrator of trade disputes released an order in March directing the Trump administration to begin issuing refunds. “You have to do it now,” a judge at the Court of International Trade, Richard Eaton, told a government lawyer during a March 4 hearing.One petitioner involved in the Supreme Court lawsuit, Learning Resources, says the refunds from the president’s misuse of the emergency economic powers act are overdue.“We are gratified by CBP’s commitment to move forward with refunds. There are still many companies struggling to obtain refunds on billions of dollars of IEEPA tariffs,” Learning Resources’s president, Rick Woldenberg, said in an emailed statement to The New York Sun on Friday. “The court and CBP need to expedite the return of all IEEPA tariffs because the Supreme Court held in our case that the government overcollected its taxes. The taxpayers should not be made to wait any longer.”More than 56,000 importers have registered to receive refunds, according to the customs agency.At least 2,000 companies preemptively sued the Trump administration in an effort to secure refunds before the Supreme Court decision. Retail giant Costco claimed the administration was refusing to extend a deadline for import records being deleted from federal registers that effectively made the tariffs non-refundable.Some companies have already pledged to pass along any refunds. Shipping company FedEx released a statement last month saying, “Our intent is straightforward: if refunds are issued to FedEx, we will issue refunds to the shippers and consumers who originally bore those charges.”Other companies that have promised to pass along any refunds include game maker Cards Against Humanity and sex toy company Dame Products.The administration has already resumed charging tariffs under different means. Mr. Trump started using Section 122 of the Trade Act of 1974 to implement the new 10 percent duty in late February. He later said he would up the tariffs to 15 percent but that has not been implemented.
