Trump Says He Expects a Supreme Court Loss on Birthright Citizenship

President Trump says he thinks the Supreme Court is going to rule against his executive order that limits birthright citizenship. Mr. Trump signed the “Protecting the Meaning and Value of American Citizenship” executive order on his first day back in the White House as part of his sweeping crackdown on illegal immigration. The order seeks to deny American citizenship to children born in America if the parents are in the country illegally or are visitors on short-term visas.Multiple lower courts have blocked the policy from being implemented but the Trump administration argues the lower courts are misrepresenting the Citizenship Clause of the 14th Amendment.Mr. Trump was complaining about the Supreme Court ruling against his tariff policy when he brought up the birthright citizenship case during a CNBC interview on Tuesday morning. Trump v. Barbara hinges on the Citizenship Clause of the 14th Amendment, which states that “all persons born or naturalized in the United States, and subject to the jurisdiction thereof,” are citizens.“They’ll probably rule against us,” Mr. Trump said of the justices.The Trump administration claims that the 14th Amendment was primarily intended to provide citizenship to children of freed slaves after the Civil War and does not apply to all children born on American soil. Several justices, during oral arguments on April 1, appeared skeptical of the government position that birthright citizenship has been misinterpreted for 140 years.Mr. Trump personally attended the Supreme Court hearing on the case, becoming the first sitting president to do so. He stayed for the government’s argument but left as the opposition offered its case.“Maybe we’re going to lose that one too,” Mr. Trump said during Tuesday’s interview, without elaborating.A group of Democrat-run states sued the administration over the policy, claiming the Citizenship Clause is broad by design.Legal precedent has largely affirmed birthright citizenship as a constitutional right since the 1898 Supreme Court case United States v. Wong Kim Ark, which granted citizenship to the American-born son of Chinese immigrants.A 6-to-2 court, in that case, held that because the child’s parents were not “employed in any diplomatic or official capacity under the Emperor of China,” they were subject to America’s “jurisdiction” — and that their child was a citizen.A decision in Mr. Trump’s case is expected by early July.
