Wall Street Floor Clerk Sues Another Clerk for $5M

The trading floor of the New York Stock Exchange deserves its reputation as a testosterone pit, according to a lawsuit filed yesterday in federal district court in Manhattan.
A floor clerk for Van Der Moolen Specialists is accusing another floor clerk from the same firm of attacking him on the Exchange’s floor.
Joseph Cunneen had returned to work from shoulder surgery on October 5, 2006, and was wearing red tape on his jacket to indicate that he was injured and should avoid being jostled, a common practice on the trading floor, the suit says.
The next day, “without provocation and without warning,” John Napoli “battered” Mr. Cunneen with punches to the shoulder, the suit claims.
Mr. Cunneen is suing for $5 million. Neither Mr. Cunneen’s attorney, Edward Westfield, nor Mr. Napoli could be reached for comment.
