Luigi Mangione’s Crowded Trial Schedule Is Thrown Into Chaos as Judge Suddenly Moves His State Murder Trial Even Closer To His Federal Trial

New York Justice Gregory Carro, who presides over the state’s murder case against the alleged UnitedHealthcare CEO killer, Luigi Mangione, pushed his trial date from June 8 to September 8 on Wednesday evening, causing more chaos in Mr. Mangione’s packed trial schedule. “The amended trial schedule is as follows: Trial will begin on September 8, 2026, replacing the previous date of June 8, 2026,” Judge Carro ruled in a written order, published shortly before 5 pm on Wednesday without giving any further explanation. Mr. Mangione faces two separate trials in New York – in state and federal court – for the killing of the CEO of UnitedHealthcare Brian Thompson, who was gunned down on a Midtown Manhattan street in December 2024. The Manhattan District Attorney’s Office indicted Mr. Mangione on nine counts, including second-degree murder, which carries a maximum sentence of life without parole. At the same time, the federal government charged Mr. Mangione with interstate stalking, alleging that he stalked Thompson, a father of two who lived outside of Minneapolis, and followed him to New York, where the executive was planning to attend an investor conference at the Hilton hotel in Midtown. The two stalking statutes also carry a maximum sentence of life in prison. Previous federal death penalty eligible firearm charges were dismissed in January. Mr. Mangione has pleaded not guilty to all charges. Judge Carro’s unexplained postponement came hours after the district judge, overseeing Mr. Mangione’s federal case had made modest changes to her trial schedule during a hearing held at federal court on Wednesday morning. As the Sun reported, the district judge, Margaret Garnett, slightly adjusted her trial dates after defense attorneys had argued that, due to the state trial scheduled for June, her schedule didn’t give them enough time to prepare for the federal trial in September, and that their client’s constitutional right to a fair trial was being infringed upon. Judge Garnett moved the start date for in-person jury questioning from September 8 to October 5 with opening statements expected to commence on October 26, or November 2. However, she made these adjustments under the assumption that the state trial was starting on June 8. Just hours later, Judge Carro moved back the state trial’s start date to September 8. There are now merely 20 working days between the two proceedings. Both state and federal prosecutors are eager to try the high profile defendant. The state prosecutors, however, must bring their charges first– otherwise they may risk losing the case. New York has stricter laws protecting defendants from being charged with the same crime twice, also known as double jeopardy, than the federal government. But these laws only apply once a jury has been sworn in. Therefore, if a jury is seated in a federal courtroom in the case against Mr. Mangione, defense attorneys can raise a double jeopardy argument and request to dismiss the state case entirely. During a hearing at Manhattan Criminal Court in February, Judge Carro indicated that he would move his trial from June 8 to September 8, but only if federal prosecutors would appeal Judge Garnett’s dismissal of the death penalty eligible charges. Federal prosecutors chose not to appeal that decision, but Judge Carro moved the date anyway. On Wednesday, Judge Garnett told the parties that she wanted to “ensure that Mr. Mangione gets a fair trial” and that “there’s really no way around taking into account the events” in the state case, which “inevitably affects the way that we structure things here.” The defense attorney had asked the judge to move the federal trial to January 2027, but the judge was “skeptical” of such a “wholesale” move, especially when the state trial had “not been adjourned” yet. “It’s a little bit of a tail wagging dog,” Judge Garnett said, adding “I don’t have any control of the state schedule.” It remains to be seen how she will respond to this latest development.
