Mangione To Use Insanity Defense at New York Trial in Killing of UnitedHealthcare CEO

Defense attorneys announced Wednesday that they will pursue an “affirmative psychiatric defense” for the man accused of gunning down a UnitedHealthcare CEO, Luigi Mangione, at his upcoming New York state trial in September. The presiding judge, Gregory Carro, said during Wednesday’s hearing at Manhattan Criminal Court that the defense had informed him their client was suffering from an “extreme emotional disturbance at the time of the occurrence.” Brian Thompson, a 50-year-old father of two, was fatally shot on a Midtown Manhattan street while on his way to an investor conference at the New York Hilton in December 2024. After a nationwide manhunt, Mr. Mangione, 28, was arrested at a McDonald’s at Altoona, Pennsylvania. He was extradited to New York and is currently being held in the Metropolitan Detention Center at Brooklyn. He attended Wednesday’s court proceeding, dressed in a navy suit and a pink button-shirt, shackled at his hands and feet. The judge ordered that all psychiatric records be turned over to prosecutors immediately. The records will be unsealed.“We haven’t gotten anything,” an assistant district attorney, Joel Seideman, protested. “We have no basis to send our expert in.” He accused the defense of having “stonewalled” his office and fumed that the victim’s family had a right to know “the why.”The judge assured the prosecutor that all information would be turned over on Wednesday or Thursday at the latest. In order for prosecutors to move forward, Judge Carro told the defense, “they need to know what the malady is that the defendant suffered from. I’m not gonna let you surprise the People on the eve of the trial. So get it done.” By claiming Mr. Mangione was “emotionally disturbed,” the defense admits he committed the crime but argues he “didn’t possess the capacity to understand what was going on,” a criminal defense attorney from Baltimore, Thomas Maronick explained to The New York Sun on Wednesday. “It’s technically a guilty plea, but the guilt is modified by the fact that you could not have been responsible for it,” said Mr. Maronick. If the jury agrees with the defense, Mr. Mangione will serve his punishment in a mental health facility instead of a prison. He will also serve fewer years because his second-degree murder charge, which carries a maximum sentence of 25 years to life in prison, would be lowered to a manslaughter charge, which carries a maximum sentence of 25 years in prison. On Wednesday, Judge Carro also dismissed count nine from the indictment, related to the possession of a large ammunition magazine, after prosecutors consented to drop the charge. When Mr. Mangione was arrested in Pennsylvania, police officers found a loaded magazine in his backpack. Because the judge found that the search was conducted unlawfully, he granted the defense’s request to suppress the magazine from the evidence. And since the magazine was not going to be included in the trial, lead defense attorney Karen Friedman Agniflo argued on Wednesday, the charge related to it should be dropped from the indictment. The judge also addressed a complaint, submitted by various media outlets, that he had not given them any reasons for sealing a conference held on June 3. Judge Carro explained on Wednesday that the “reasons for the sealing was to give the defense an opportunity to see if they were going forward with” the affirmative psychiatric defense. Ms. Friedman Agifilo turned to the courtroom pews, where the reporters were seated, and noted, “This defense is not available federally, and he is being prosecuted federally about the exact same case.”Mr. Mangione faces stalking charges in the Southern District of New York, where federal prosecutors accuse him of stalking Thompson across state lines. Under the Insanity Defense Reform Act of 1984, federal law recognizes a mental health defense, but the limitations are stricter. Until the documents are unsealed, it’s unclear what the exact mental health defense claims. Judge Carro scheduled the next hearing at Manhattan Criminal Court for August 11. Mr. Mangione is due in federal court on June 29.
