NCAA and Athletic Directors Are Up in Arms Over Court Decision Allowing Admitted Gambler To Play

Shock, anger and anxiety over an uncertain future were the predominant reactions after a District Court judge in Lubbock County, Texas, granted a temporary restraining order last week allowing admitted gambler Brendan Sorsby to play a final season at Texas Tech.Mr. Sorsby, who was ruled ineligible to play by the NCAA after admitting he wagered on his own team while attending Indiana, will now likely take the field for his final college season in Lubbock, and pocket the estimated $5 million he is scheduled to earn in Name Image and Likeness deals.If the ruling by Judge Ken Curry stands, it creates a controversial pathway back for athletes who bet on their own games, raising profound questions about the integrity of college sports and what the consequences should be for adolescent gambling addictions.Last week’s announcement sent shock waves around college athletics. Big 12 Commissioner Brett Yormark immediately called for an emergency meeting of conference athletic directors and the executive board.“The ramifications of today’s ruling are significant and could have broad impact across college athletics,” Mr. Yormark said in a statement posted on X, adding he anticipates the NCAA will “appeal the order in the next 24-48 hours.”ACC Commissioner Jim Phillips told ESPN, the ruling is part of a pattern that is “eroding the integrity of our process,” while Florida athletic director Scott Stricklin said he was “stunned” the court sees someone betting on their own team as acceptable.“That’s not a judgment on the young man,” Mr. Sticklin told ESPN. “It’s just that it was a pretty fundamental tenet of American sports, that if you’re going to participate, you can’t gamble, especially on your own team.”Mr. Sorsby’s legal team headed by Jeffrey Kessler, the powerhouse attorney who negotiated the House settlement against the NCAA, successfully argued that Mr. Sorsby has a diagnosed mental health addiction and anxiety-driven compulsion.The 22-year-old quarterback, who played two years at Indiana and two years at Cincinnati before transferring to Texas Tech, recently completed a month-long stay in a residential treatment program in Arizona. He entered the program in March at the start of the NCAA’s investigation into his gambling habits. Mr. Kessler claimed a clinician who treated Mr. Sorsby said that not allowing him to play this season would hurt his mental health and impede the progress of his recovery.Mr. Kessler also pointed out the disparity in how the NCAA handles substance abuse versus behavioral addictions. While drug and alcohol dependencies have established rehabilitative paths back to competition, a gambling disorder can trigger a rigid lifetime ban. Mr. Sorsby’s legal team said by issuing a lifetime ban, the NCAA was effectively weaponizing a medical illness. The initial 514-page lawsuit accused the NCAA of a “wholesale abandonment of its obligations and duties to promote well-being.”Under an agreement with the court, Mr. Sorsby will miss the first two games of the season. It’s a substantially lesser penalty than facing a lifetime ban and losing out on the multi-million dollars he is scheduled to make in NIL earnings from the school. While the NCAA is expected to appeal to a higher court in Texas, overcoming Mr. Kessler’s legal momentum may prove to be a wasted effort.The NCAA blasted Mr. Curry’s ruling, issuing a statement saying it is “deeply concerned about the damaging, far-reaching and broadly destabilizing ramification of this outcome—which undermines and corrupts the integrity of sports.”In presenting its case, the NCAA reaffirmed its commitment to supporting student-athlete mental health but warned allowing Mr. Sorsby to play another college season would do “reputable harm” to the governing body.The NCAA argued that it “must continue to aggressively defend against actions that defraud college athletics and threaten competitive integrity, such as betting on one’s own sport.”According to court documents, Mr. Sorsby admitted making bets totaling at least $90,000 during this time at Indiana, Cincinnati and Texas Tech. He said he placed 40 bets on Indiana while a freshman in 2022, though he didn’t play in any of the games for the Hoosiers.Mr. Sorsby, who admitted gambling since high school, explained in an affidavit that he bet on his own team to “feel more connected to the team, to root for my friends, and to feel like I had a real stake in the game that I was otherwise not involved in.”He noted he stopped betting on Indiana games once he was promoted to a backup and eventually became a starter. However, he continued to bet on sports like Romanian soccer matches, the Turkish basketball league, UFC, tennis, Major League baseball and even the Nathan’s Hot Dog Eating Contest.Reaction on social media forecasted impending doom for the NCAA. “Death blow to college football. Sad times,” was one post on x in reaction to the decision. “A shame on the entire sport,” posted another.Another user summarized the widespread frustration: “The NCAA is the biggest joke of an organization and really should just fold if they can’t keep someone who bets on their game out of their competition. They need new lawyers and new rules.”As anticipated, the NCAA has appealed the ruling, asking a Texas appeals court last Monday to halt the temporary injunction that cleared Mr. Sorsby to play. The Big 12 Conference has also filed a federal lawsuit seeking to affirm its authority to enforce its bylaws, arguing that Texas Tech is reneging on rules it had previously accepted. The filing names Texas Attorney General and Republican Senate nominee, Ken Paxton, and senior Texas Tech officials.
