Surprise Federal Court Hearing in Luigi Mangione Case Raises Speculation on Possible Plea Deal

Just hours after Luigi Mangione, accused of assassinating UnitedHealthcare CEO Brian Thompson, appeared in a Manhattan courtroom on Tuesday, a sudden conference was scheduled in his federal case for Friday, raising speculation that a plea deal could be in the works.“The parties write jointly to request a conference with the Court,” a letter filed on Tuesday afternoon read. It was signed by United States Attorney for the Southern District of New York James McDonald. He asked that the conference be held on Friday at 11 a.m. The district judge overseeing the case, Margaret Garnett, granted the request. No further details were provided.Mr. Mangione is being prosecuted in state and in federal court for the same crime: the fatal shooting of Thompson on a Midtown Manhattan street in December 2024. Manhattan prosecutors have charged the 28-year-old Baltimore native with second-degree murder and weapon offenses, while federal prosecutors charged him with interstate stalking. Both state and federal charges carry maximum life sentences. Mr. Mangione has pleaded not guilty to all counts. During Tuesday’s hearing at Manhattan Criminal Court, the parties briefly discussed jury selection and media access for the upcoming state trial, set to begin on September 8. But these plans could change drastically if Mr. Mangione decides to take a plea deal in his federal case, which is scheduled for trial in January 2027. Sources told ABC News in June that Mr. Mangione had discussed a “possible guilty plea” with federal prosecutors. But lead defense attorney Karen Friedman Agnifilo quickly dismissed these negotiation reports and accused the media of deliberately attempting to prejudice the jury pool.Her defense team, however, has been quite vocal about the fact that their client faces two trials for the same crime in two separate jurisdictions. “This is a tug of war between different prosecution offices,” Ms. Agnifilo told New York Supreme Court Justice Gregory Carro during a hearing in February. And her client agreed. As Mr. Mangione was being led out of the courtroom by court officers that day, he turned to the gallery pews and said loudly, “Same trial twice. One plus one is two. Double jeopardy by any commonsense definition.” Although the Constitution safeguards individuals from double jeopardy, a key exception exists: the dual-sovereignty doctrine. Under this principle, the Supreme Court has ruled that both federal and state governments can prosecute an individual for the same criminal act. Because they operate as two separate sovereign entities, a single crime can violate the laws of both jurisdictions. The UnitedHealthcare CEO, a 50-year-old father of two, was fatally shot on a sidewalk before he entered the New York Hilton on Sixth Avenue and 53rd Street. Murder cases like these are usually prosecuted in state courts, and since the shooting occurred on a Manhattan sidewalk, it falls into New York State’s jurisdiction. In January, state prosecutor Joel Seidemann sent a letter to Judge Carro, writing that the murder happened “on our streets,” and that New York State had “every reason to be the prosecuting authority.”However, when an element of a crime crosses state lines, it becomes a federal matter. Federal prosecutors argued in their indictment that Mr. Mangione did just that by stalking Thompson, who was based in the Minneapolis area, and allegedly tracing the CEO’s movements from Minnesota to New York, where he planned to attend an annual investor conference at the Hilton Hotel.Under legal precedent, federal law permits both prosecutions. But New York State has its own laws to protect against double jeopardy. In an earlier ruling, Judge Carro pointed out that the protection is “greater” than that in the “federal Constitution,” but that “that bar is triggered only when a prior prosecution ends in a conviction by guilty plea, or once a jury has been sworn.”In other words, securing a plea deal with federal prosecutors before the state trial begins would clear the way for Mr. Mangione to seek a dismissal of his state case under New York’s successive prosecution statute.“A person cannot be separately prosecuted for multiple offenses that arise out of the exact same act or criminal transaction,” the statute reads. Mr. Mangione is charged with multiple offenses, stalking and second-degree murder, but they arise from the same act: the fatal shooting of Thompson. State prosecutors could push back by arguing that the murder case qualifies for an exception because the statutory provisions target very different harms: stalking and murder. Ultimately, the decision of whether to proceed with the state trial would rest with Judge Carro.In an email to the New York Sun on Tuesday evening, criminal defense attorney Elena Fast, who has defended clients in both federal and state court, signaled caution regarding any plea deal prediction for Friday’s conference.“The subject of Friday’s conference has not been identified in the public filing,” Ms. Fast wrote. “I do not think the Friday conference is a plea because it is not docketed as a ‘change of plea hearing.’” She cited the district judge’s individual rules, which request an advance notice for changes of plea hearings.Another possibility, according to Ms. Fast, is transportation logistics. Because Mr. Mangione is housed at a federal jail in Brooklyn, U.S. Marshals must transport him for state appearances. This logistical hurdle caused a hearing to be rescheduled on June 16, because state prosecutors failed to notify federal authorities of his required presence. “My first guess is that the parties are working out the logistics of transporting Mr. Mangione from federal custody at the MDC to state court for trial,” Ms. Fast wrote, “ensuring he arrives on time, is dressed appropriately, and has lunch arranged. My second guess is that it’s a change of plea hearing that they are keeping under wraps.”“If the federal case resolves first, it is very difficult to predict what will happen to the New York state case. Time will tell,” Ms. Fast concluded.
