Ex-Wife of Slain Dentist Is Held Without Bail

The ex-wife of a Queens orthodontist charged with hiring a hit man to kill him front of their 4-year-old daughter is being held without bail after her arraignment in Queens this morning.
Mazoltuv Borukhova is accused of hiring her uncle to kill her ex-husband, Daniel Malakov, a Columbia University trained orthodontist, after a protracted custody battle over their daughter. According to Mr. Malakov’s family members and law enforcement officials, he had won full custody of his daughter days before his October 28 shooting in a Queens playground, but had agreed to give Ms. Borukhova visitation rights.
On the Sunday morning of the shooting, the couple had planned to meet in the park so that Ms. Borukhova could visit with their daughter.
An indictment released yesterday by District Attorney Richard Brown of Queens charges that Ms. Borukhova arranged with her uncle by marriage, Mikhail Mallayev, to shoot her ex-husband on the morning of the planned meeting.
According to the indictment, Ms. Borukhova and Mr. Mallayev, a resident of Georgia, had spoken on the phone more than 90 times during the weeks proceeding the shooting.
That day, Mr. Mallayev arrived at the playground and fired twice at Mr. Malakov’s chest as Ms. Borukhova and the couple’s daughter stood nearby, according to the indictment.
Police Commissioner Raymond Kelly said at a news conference this morning that Ms. Borukhova’s statements following the shooting had led detectives to suspect her involvement.
She told detectives she hadn’t heard the shots, although several witnesses, including a police officer, said that they had heard shots fired.
The police department had Mr. Mallayev’s fingerprints on file from a previous arrest for subway turnstile jumping, and detectives were able to track Mr. Mallayev to Georgia after they found his fingerprints on a bleach bottle dropped at the scene. The bottle had been used as a makeshift gun silencer.
Two weeks after the shooting, Mr. Mallayev deposited $19,800 into 10 different bank accounts, the indictment said.
Mr. Mallayev was arrested in Georgia in November, and arraigned in Queens on January 17 on a second-degree murder count and criminal possession of a weapon.
Ms. Borukhova was arrested yesterday at her home in Forest Hills.
Both Mr. Mallayev and Ms. Borukhova were arraigned today on new charges of first-degree murder, intentional second-degree murder, and second-degree conspiracy. They both face life without parole if convicted.
The shooting rocked the close-knit Bukharian Jewish community in Forest Hills, where both Mr. Malakov and Ms. Borukhova’s families were well known and respected. Thousands attended Mr. Malakov’s funeral in the fall, and expressed shock at speculation that Ms. Borukhova may have been involved in the killing.
In a statement yesterday, Mr. Brown said, “The charges are particularly shocking. A young father with a great deal to look forward to in his life was unceremoniously gunned down on a quiet Sunday morning in full view of his four-year-old child.”
