Government Sued Over Health Insurance Program

Several states, including New York, are suing the federal government over what they charge are unfair restrictions to a health insurance program geared toward low-income children who are not eligible for Medicaid.
The suit, filed yesterday in U.S. District Court in Manhattan against the U.S. Department of Health and Human Services, also includes Illinois, Maryland, and Washington.
The states are calling on the federal government to invalidate stricter requirements they created for the State Children’s Health Insurance Program in August, claiming they will be unable to sufficiently expand their state insurance programs with the “stringent” new requirements, according to the complaint.
In New York, the program now covers children whose family incomes do not exceed 250% of the federal poverty limit, but the state wants to expand the program to cover family incomes that are at or below 400% of that limit, according to the suit.
