Alberta Backpedals on Medical Assistance in Dying as Other Canadian Provinces Push To Expand It

Canada’s province of Alberta is preparing to assert provincial control over medical assistance in dying by introducing strict new limitations, marking a sharp contrast to provinces like Quebec that are expanding access.During a preview of the spring legislative session, Alberta Government House Leader Joseph Schow announced that the province will introduce legislation prohibiting MAID for vulnerable groups. The ban will include mature minors, individuals seeking advance requests, and Albertans whose sole underlying condition is a mental illness without a qualifying physical ailment.Mr. Schow pointed to a lack of adequate federal safeguards as the primary driver behind the province’s legislative push.“The federal government has rapidly expanded (MAiD) and even plans to make it available to those with mental health challenges as their sole underlying condition,” Mr. Schow said in a statement, referencing a temporary federal prohibition on MAiD for mental illness that is scheduled to expire in March 2027.Alberta’s legislative push comes as national data reveals that assisted suicide accounted for nearly one in 20 deaths in Canada in 2023. According to a Health Canada report in late 2025, more than 76,000 Canadians have died by assisted suicide since its legalization in 2016.Disability rights advocates in Alberta have welcomed the provincial government’s swift action, particularly the implementation of safeguards prior to the expiration of the federal mental health exemption. “This is a big priority. This is literally life and death,” Trish Bowman, head of the disability-rights group Inclusion Alberta, said in a statement. While provinces like Quebec continue to liberalize access — accounting for 36 percent of recorded MAiD deaths nationwide despite having only 22 percent of the population — Alberta’s forthcoming legislation signals a definitive, restrictive shift in how the western province will manage the federal program.Meanwhile, a report last month from Ontario’s Chief Coroner showed that 65 people in the province died by assisted suicide or euthanasia on the same day they made their requests in 2023, sparking renewed concerns about safeguards in the MAiD program.The Medical Assistance in Dying Death Review Committee report also found that an additional 154 people died the day after making their requests, raising questions about whether adequate time is being provided for reflection and whether proper end-of-life care alternatives are being offered.Canada’s original MAiD legislation included a mandatory 10-day waiting period between requesting and receiving assisted dying. Parliament eliminated the requirement in 2021 for individuals whose deaths were deemed “reasonably foreseeable,” though no specific criteria were established for determining when same-day procedures should be permitted.The Ontario report noted that “most often, the provision of MAiD within the same day or next day of a written request is completed for persons who present with profound intolerable suffering, severe clinical and functional decline (i.e., imminent death), and/or when there is a risk for loss of decisional capacity to provide informed consent.”Committee members expressed concern that the ease of accessing assisted dying compared to quality end-of-life care may be influencing decisions. The report states that “[m]any members opined that poor quality end-of-life care potentially impacted the request for a brief MAiD provision timeline.”“Some members expressed their concern that access to MAiD was more easily organized and accessible in this circumstance than the previously requested and preferred option for end-of-life care,” the report added.At the end of the report, the committee concluded that “most members agreed that a person’s request for an urgent MAiD provision should not be prioritized over maintaining MAiD practices that are thorough, complete, representative of quality care, and meeting legislative requirements of eligibility and safeguards.”
