A state appeals court has reinstated an indictment against a former television host who tried to parachute off the Empire State Building.
The Supreme Court’s appellate division revived the reckless endangerment charge against 31-year-old Jeb Corliss of Malibu, Calif., but lowered it from a first-degree felony to a second-degree misdemeanor.
Security guards at the landmark stopped Mr. Corliss on the 86th floor observation deck in April 2006 as he prepared to jump.
The appeals court yesterday rejected the lower court’s ruling that, because the guards stopped Mr. Corliss, he could not have endangered people on the street below.
The court said a variety of accidents could have occurred.
Mr. Corliss’s lawyer, Mark Heller, said he is considering an appeal to the state’s highest court.
