In response to the editorial published on January 25, 2007 regarding NYCERS’ lawsuit against Apple computers [Editorial, “New York Versus Apple,” January 25, 2007], Grant & Eisenhofer is one of nine law firms serving in the New York City pension funds’ pool of securities litigation law firms.
These nine firms were selected pursuant to a competitive bidding process. In accordance with a protocol established by the pension funds for securities litigation, the NYCERS Board of Trustees voted in favor of proceeding with the Apple litigation and engaging the services of Grant & Eisenhofer after first having considered evaluations of the litigation by two other law firms in the securities litigation pool, and a recommendation from the Law Department.
Now that NYCERS has been designated lead plaintiff in the litigation, a retainer agreement with Grant & Eisenhofer, which will include a contingency fee agreement, is being negotiated.
Leslie Conason was not involved in the process by which the current ninemember securities litigation pool was chosen, nor was she involved in NYCERS’ decision to proceed with this litigation, and to engage the firm of Grant & Eisenhofer.
