Tale of ‘Failed Threesome’ With Italian Actress Takes Center Stage at Weinstein Trial as Accuser Details ‘Breakdown’ Over Producer’s Sexual Demands

Former aspiring actress Jessica Mann testified about her dramatic breakdown during what she claimed was a “failed threesome” involving herself, the Italian actress Emanuela Postacchini and the disgraced film producer Harvey Weinstein at his rape retrial on Tuesday. “I remember she took her clothes off,” Ms. Mann told the court, referring to Ms. Postacchini. She said Weinstein “wanted us to have a threesome.” “She was laying on the bed,” Ms. Mann went on, weeping as she spoke. “I grabbed her boob.” Then Ms. Mann said, “I ran into the bathroom… I was just crying… And I had a full on breakdown.” Ms. Mann remembered Ms. Postacchini came into the bathroom. “She tried to comfort me,” Ms. Mann testified. “And she was being really kind.” The alleged incident occurred in February 2013 at the Montage Beverly Hills hotel. Ms. Mann, who is 40 today, was 27 years old then. Weinstein, who was sitting in the courtroom in his wheelchair, turned 74 in March. He was 60 when he allegedly tried to have a threesome with the two young actresses. Ms. Postacchini, 34 today, was only 22 years old then. Ms. Postacchini, who testified against him in the original, 2020 trial, did not show up this time. The defense says she is a liar.Weinstein is accused of raping Ms. Mann at a Midtown Manhattan DoubleTree Hotel in March 2013. In 2020, the Manhattan District Attorney’s office charged Weinstein with having raped Ms. Mann in the first and in the third-degree, a stark difference in prison years. The jury acquitted him on the first-degree count, which carries a maximum sentence of 25 years, and convicted him on the third-degree count, which has a 4 year maximum. Weinstein still received a 23 year sentence following his 2020 trial because he was also convicted of a more serious sexual offense involving a different woman, Miriam Haley. That jury convicted Weinstein again in the case of Ms. Haley, but failed to come to an agreement regarding Ms. Mann’s allegations. The judge declared a mistrial. Now, a new batch of Manhattanites, composed of seven men and five women, is taking a jab for a third time at the lingering question– did Weinstein rape Ms. Mann or not. The case is complicated because Ms. Mann and Weinstein were in an on-and-off again relationship for four years that included sexual encounters which Ms. Mann has described as somewhat consensual. She insists, however, that the incident at the DoubleTree hotel was rape. Weinstein has pleaded not guilty to all charges and has denied all allegations of sexual misconduct against him. He claims his accusers are angry at him for not providing them with fame and fortune. She admitted she consented to the three-way encounter. “He wanted us to have a threesome,” she testified, adding “I started to agree to participate with him.” She told the jury she later fictionalized the incident in an anonymous blog post under the title “The failed Threesome.” The story began with the sentence, “I have succeeded at failing at my threesome.” Weinstein allegedly told her later, “I’ll never do that again with you.” She said Ms. Postacchini’s “beauty was ridiculous,” but that she was not “sexually attracted” to the Italian actress. She also said, “I felt like I was looking at myself,” when she saw Weinstein perform oral sex on the other young woman. John Angelillo-Pool/Getty Images“Like how I was trying to object,” Ms. Mann explained, referring to incidents she had described earlier, when she gave into Weinstein’s sexual demands out of fear he would retaliate against her and destroy her acting career. Ms. Mann said she watched Ms. Postacchini undergo a similar forced experience. “She was laying on her back and he was kind of down between her legs… She also appeared in distress to me… I didn’t feel that she was comfortable with what was happening,” Ms. Mann said, wiping away tears. During Weinstein’s first trial in 2020, Ms. Postacchini testified that she had had a previous sexual encounter with the film producer, whom she met at the Venice Film Festival in 2012. AP Photo/Richard DrewShe did, however, corroborate the threesome and Ms. Mann’s breakdown in the bathroom, where she found her “in a fetal position on the ground crying,” the Post wrote. Under cross-examination, Ms. Postacchini told defense attorneys that she “felt manipulated into a situation” she “didn’t want to be (in),” a “situation,” she described as “forced.”Last week, an Assistant District Attorney, Nicole Blumberg told the judge that she wanted to “read” Ms. Postacchini’s testimony from the 2020 trial into the current record, because the Italian actress was “unavailable” to testify. AP Photo/Ted ShaffreyMs. Postacchini did not testify last year, Ms. Blumberg said, because “she was out of the country for the duration of the 2025 trial.” When prosecutors contacted her in 2025, “she was hysterically crying,” Ms. Blumberg explained, adding that the actress said, “she didn’t remember anything, that she spent significant time in therapy.” The Manhattan District Attorney’s office reached out to Ms. Postacchini again, asking if she would testify at the ongoing trial. I mean this is made up,” Mr. Agnifilo said, shaking his head.Prosecutors did not read Ms. Postacchini’s testimony into the record and the subject has not come up again in court. Ms. Mann will return to the stand on Wednesday morning.
