Court Sends Back Tobacco Case

A federal appeals court yesterday ruled that small tobacco companies may have a valid legal argument that the 1998 pact between major tobacco firms and 46 states runs afoul of the Constitution by effectively setting nationwide prices for cigarettes. The case was sent back to a lower court for further hearings.
