E. Jean Carroll, Fresh Off Supreme Court Win, Demands ‘Dilatory’ Trump Pay Her $5 Million Immediately

The sex and advice columnist E. Jean Carroll is eager to collect the $5 million owed to her by President Trump — and is asking a federal court at the Southern District of New York to help her secure the funds.Last week the Supreme Court rejected Mr. Trump’s request to review the $5 million civil judgment imposed after a Manhattan jury found in 2023 that he sexually abused and then defamed Ms. Carroll. At issue was an alleged encounter in a Bergdorf-Goodman dressing room sometime in the mid 1990s.Mr. Trump appealed the $5 million verdict first to a panel of the Second United States Appeals Circuit, which declined to disturb the judgment. The Second Circuit, finding that no “claimed error or combination of errors affected Mr. Trump’s substantial rights,” also demurred from granting his request for an en banc hearing, or consideration by the full tribunal. The high court passed on the case with no dissents.The president is also mounting a separate appeal of another judgement secured by Ms. Carroll in 2024 — for $83 million on account of further defamation of her by Mr. Trump. That brings the total amount owed by the 47th president to Ms. Carroll to more than $100 million, accounting for the accrual of interest. His obligation to pay, though, is frozen until his appeals are exhausted.Now Ms. Carroll, 82, is asking Judge Lewis Kaplan to ensure that “this is the end of the line” for Mr. Trump’s efforts to avoid paying her. She writes that “after four years of litigation across every level of the federal court system, it is time for this case to end” with “payment of the money due under the judgment.”Ms. Carroll’s efforts to collect are aided by the transfer, back in 2023, of that $5 million into an account controlled by the Court called a “registry.” After the Supreme Court denied Mr. Trump’s appeal the president took to Truth Social and vowed to “continue the fight against this Weaponization and Lawfare Case” with “all of my power and strength.” He also called the litigation a “Fake Case brought against me by a woman I never met.”Mr. Trump has called Ms. Carroll’s claim a “total lie” and offered that she is not his “type.” During a deposition he called her a “total nut job.” Last year Ms. Carroll, who wrote a column for Elle for 27 years, released a book — it topped the New York Times’s best-seller list for a spell — titled “Not My Type: One Woman vs. a President.”Ms. Carroll argues in her latest filing that Mr. Trump was obligated to pay as soon as the Supreme Court denied his writ of certiorari. The president’s legal team, though, tells Judge Kaplan that they are contemplating a motion asking the Nine to reconsider their appeal. Ms. Carroll responds that the “plain” text of the understanding refutes that interpretation and that the “Court should direct the Clerk to disburse to Carroll the value of the judgment including post-judgment interest, which amounts to $5,779,783.00 in total.”Ms. Carroll tells the court that Mr. Trump’s request for a delay is of a piece with “litigation tactics that have had a dilatory effect and, indeed, strongly suggest that he is acting out of a strong desire to delay” in this case. Ms. Carroll asks Judge Kaplan to “reject his latest effort to delay and instead bring this long-running litigation to an end.” Judge Kaplan and Mr. Trump have locked horns, with the president calling the judge “abusive, rude, and obviously not impartial.”Judge Kaplan presided over both of Ms. Carroll’s cases against Mr. Trump. Even though the jury in the first litigation found Mr. Trump liable for sexual abuse but not rape, the judge editorialized in a filing that “the finding that Ms. Carroll failed to prove that she was ‘raped’ within the meaning of the New York Penal Law does not mean that she failed to prove that Mr. Trump ‘raped’ her as many people commonly understand the word ‘rape.’”Mr. Trump has not yet filed a writ of certiorari to the high court for the $83 million verdict, though he has signaled to the Second Circuit that such an appeal is imminent. The president plans to ask the justices to substitute the Department of Justice as the defendant in the case. That would end the litigation, as courts have held that America cannot be sued for defamation.
