Former Fauci Adviser Indicted Over Alleged Effort To Hide COVID-19 Communications

A former senior adviser to Dr. Anthony Fauci has been indicted on allegations that he used a private email account to conceal government communications about Covid-19, including discussions tied to the virus’s origins and a controversial research grant linked to the Wuhan Institute of Virology.Federal prosecutors say David M. Morens, 78, who served in the National Institute of Allergy and Infectious Diseases from 2006 through 2022, worked with others during the pandemic to move official discussions off government systems and out of public view. The Justice Department unsealed the indictment on Tuesday.Dr. Morens, of Chester, Maryland, is charged with conspiracy against the United States; destruction, alteration, or falsification of records in federal investigations; concealment, removal, or mutilation of records; and aiding and abetting, according to a Justice Department press release.“These allegations represent a profound abuse of trust at a time when the American people needed it most — during the height of a global pandemic,” said the acting attorney general, Todd Blanche. “As alleged in the indictment, Dr. Morens and his co-conspirators deliberately concealed information and falsified records in an effort to suppress alternative theories regarding the origins of COVID-19. Government officials have a solemn duty to provide honest, well-grounded facts and advice in service of the public interest — not to advance their own personal or ideological agendas.”Prosecutors allege the conduct centered in part on communications surrounding a grant titled “Understanding the Risk of Bat Coronavirus Emergence,” which involved collaboration with the Wuhan Institute of Virology in Wuhan, China. The grant was later terminated amid scrutiny and debate over whether Covid-19 may have emerged from a lab leak.According to the indictment, Dr. Morens and several others allegedly agreed to use his personal Gmail account to exchange non-public information after anticipating that their communications could be requested under the Freedom of Information Act. Prosecutors say the group used the private account to discuss efforts to influence funding decisions, circulate drafts of letters for NIH leadership, and share internal information that should have remained on official government systems.Investigators say the communications also involved “back-channeling” information to senior officials, including leadership that later briefed the White House, Congress, and the public during the pandemic. Prosecutors contend those messages were federal records and should have been preserved accordingly.The indictment further alleges that Dr. Morens received gifts from a collaborator while helping shape discussion around the origins of Covid-19. Those gifts allegedly included wine delivered to his Maryland home, as well as discussions of meals at Michelin-starred restaurants in Paris, New York, and Washington, D.C.“Circumventing records protocols with the intention of avoiding transparency is something that will not be tolerated by this FBI,” Director Kash Patel said in a statement. “Not only did Morens allegedly engage in the illegal obfuscation of his communications, but he received kickbacks for doing so. If you have engaged in activity conspiring against the United States, we will not stop until you face justice.”Federal authorities say the Fauci adviser later identified official acts he could perform to justify those perks. Among them, prosecutors allege, was contributing to a scientific commentary supporting the theory that Covid-19 emerged naturally rather than from the Wuhan lab. One gift was described in the indictment as payment for his “behind-the-scenes shenanigans,” according to prosecutors.Dr. Morens had previously drawn attention from House lawmakers over emails tied to Covid-era communications. During congressional testimony, he said he regretted the tone of some of his messages and referred to certain remarks as “black humor.”The case adds to ongoing scrutiny of how federal health officials handled sensitive questions during the pandemic, particularly the debate over Covid-19’s origins and the government’s communications with outside collaborators.If convicted, Dr. Morens could face substantial prison time. Prosecutors say the conspiracy charge carries a maximum sentence of five years. Each count involving falsification of records carries up to 20 years, while counts tied to concealment or destruction of records carry up to three years each.United States Attorney Kelly O. Hayes said the allegations strike at the heart of public accountability during a national crisis. “When public officials deliberately circumvent the law to hide their communications from the public, they undermine the public’s trust and the integrity of our institutions,” she said. “This was especially true during the COVID-19 pandemic when transparency was needed most.”
