Harvey Weinstein’s Latest Rape Re-Trial Runs Into a Roadblock: Luigi Mangione

The date for the upcoming rape re-trial against the disgraced movie producer Harvey Weinstein hinges on the undetermined trial dates of the accused killer of UnitedHealthcare CEO Luigi Mangione. Mr. Mangione and Weinstein are both represented by the same Manhattan law firm, Agnifilo Intrater, after Weinstein dropped his previous legal team in favor of noted defense attorney, Marc Agnifilo. And the uncertainty of Mr. Mangione’s upcoming trial dates has now spilled over into the scheduling of the film producer’s case. On Wednesday, the judge presiding over Weinstein’s third trial on the same rape charge, Curtis Faber, held an afternoon pre-trial hearing at Manhattan criminal court to discuss various motions. He also addressed the possibility of moving the trial date from April 14 to the end of May, the week after Memorial Day weekend to allow the defense attorneys more time to examine a large batch of evidentiary emails that they have not yet received. This date would collide with a Weinstein trial at the end of May. But the June 8 date could get pushed back to September, the attorneys explained in court on Wednesday. As the Sun reported, Mr. Mangione faces two separate trials in New York for the alleged killing of UnitedHealthcare CEO Brian Thompson. He is charged with second-degree murder and other crimes by the Manhattan district attorney’s office at Manhattan criminal court. At the same time, he faces stalking charges at the Southern District of New York with in-person jury questioning set to begin on September 8. Last week, defense attorneys for Mr. Mangione filed a letter, asking the district judge to move the federal trial from September 2026 to January 2027, arguing that the two trials are too close to each other and would infringe on their client’s constitutional rights to a fair trial. Curtis Means-Pool/Getty ImagesProsecutors filed a response letter on March 21, arguing that the scheduling problem could be resolved by “targeted modifications” rather than moving the entire trial to next year. “The Government further submits that the public’s interest is both substantial and compelling, and is best served by proceeding to trial without delay,” federal prosecutors wrote. The district judge, Margaret Garnett, ordered the parties to appear in her courtroom next week on April 1 to argue their positions. This leaves Weinstein’s case in limbo. Jefferson Siegel/Getty ImagesOn Wednesday, defense attorneys for Weinstein laid out their hopeful domino effect for Judge Faber at Manhattan criminal court: If Mr. Mangione’s federal case is pushed to January 2027, his state case would be pushed to September 2026, and they could easily move Weinstein from April to May.An assistant district attorney, Nicole Blumberg, told the judge her team was ready to stick to the original date and start the trial on April 14. She also said she needed to organize the flights for her witnesses. “I am willing to give this two more days,” Judge Faber said. But it is highly unlikely that the matter will be resolved in the next two days as the federal judge will not see the parties until next week. According to his spokesperson, Juda Englemayer, there was a “breakdown in coordination between the Court and the Department of Correction.” Weinstein is currently being held on New York City’s notoriously squalid Riker’s Island. He “was transported to the courthouse early this morning under the belief that his appearance would be at 9:30 a.m., when in fact the proceeding was scheduled for later in the afternoon,” Mr. Englemayer. continued. Indeed, Judge Faber had scheduled the hearing for 3:30 pm last week. He told the parties that the film producer expressed his nuisance over the long wait and wanted to leave the courthouse, and was thus sent back to the jail. Mr. Englemayer told the Sun in an email on Wednesday evening that Weinstein was “woken very early, transported while not in good health, and then returned to Rikers without being able to participate in the hearing. Given his medical condition, that sequence was understandably frustrating. Weinstein is being accused by the onetime aspiring actress and current hairstylist Jessica Mann of raping her at a Manhattan hotel in 2013. It will be the third time her case is heard in a courtroom at Manhattan criminal court.In 2020, Weinstein had his first trial, where he was found guilty of Ms. Mann’s charge and also guilty of committing a criminal sexual act against the former production assistant Miriam Haley. The judge sentenced him to 23 years in prison.Then, in 2024, New York’s Court of Appeals overturned those convictions and ordered a new trial. The court had found that the trial judge wrongly admitted testimony against Weinstein based on vivid allegations from women – including “Sopranos” star Annabella Sciorra – who were not part of the indictment. He is currently being held at the Rikers Island infirmary, where he recently told an interviewer he is dying. Weinstein’s second New York trial took place in the spring of 2025. The Manhattan jury rendered a split verdict on the three-count indictment. He was found guilty of committing the same criminal sexual act against Ms. Haley. But he was acquitted of a sex crime charge brought by a former Polish model, Kaja Sokola. Ms. Mann’s accusation of third-degree rape remained unresolved. The judge declared a mistrial after the jury’s foreman declined to return to the deliberation room, stating on the record that deliberations had become intolerable for him. After Weinstein refused to take a guilty plea, the Manhattan District Attorney’s office decided to go to trial for a third time. Weinstein faces a maximum of 25 years in prison for the conviction of Ms. Haley’s charge. His attorneys are working on an appeal. He will be sentenced after the third trial has been decided. The maximum sentence for the Ms. Mann third-degree-rape charge is four years.
